Positive Duty under the Sex Discrimination Act

 

In December 2022 new positive duty laws were introduced for all employers, no matter the size of your business. It is now an enforceable legal obligation to take proactive and meaningful action to prevent unlawful conduct from occurring in the workplace or in connection to work, including;

  • discrimination on the grounds of sex in a work context
  • sexual harassment in connection with work (including from customers or suppliers)
  • sex-based harassment in connection with work
  • conduct creating a workplace environment that is hostile on the grounds of sex
  • related acts of victimisation.


This is a significant change to your legal obligations, and you need to take action if you haven’t already. Whether you’re a sole trader, self-employed, small, medium or large business – you must meet your positive duty obligations, or you open your business to financial and reputational risk.
